Freedom for sex deal flops: Cop up for rape

A 33-YEAR-OLD police officer stationed at Nkulumane Police Station in Bulawayo has been arrested after he allegedly raped a 16-year-old girl in the holding cells.

The girl had been detained overnight for theft.

Lovemore Takura who resides at Ross Camp, is alleged to have committed the offence last Thursday between 7PM and 4AM.

The complainant is from Old Pumula suburb and had been arrested on the day accused of theft.

Police sources said Takura allegedly raped the teenager once without a condom.

“The officer was on night duty guarding the holding cells where the complainant and other suspects were detained.

“He is said to have approached the teenager and threatened to take her straight to prison if she refused to have sex with him. He then forced himself on her,” said the source.

The source said the girl only revealed the rape ordeal after she was taken to court.

Another source said Takura is denying that he raped the teenager.

“He is denying that he raped the girl saying he had consensual sex with her. He claims they had sex after striking a deal that he would release her from the cells and ensure she does not go to court to face theft charges.

“He said the teen reported him to his superiors after he failed to keep his promise,” said another source.

Bulawayo police spokesperson Inspector Precious Simango could not be reached on her cell phone for comment.

President Mugabe last week bemoaned the increase in rape cases saying Government will soon promulgate a law that will ensure rapists rot in jail.

“Our society continues to be appalled by the rising incidence of rape. I, therefore, call upon all families, churches, schools, politicians and the traditional leadership to fight against this grossly decadent practice”, said President Mugabe while opening the Fifth and last Session of the Eighth Parliament
He said on its part, Government will bring to Parliament, the Mandatory Sentencing for Rape and Sexual Abuse Bill, which provides for more deterrent measures against the perpetrators of the repulsive crime.

In July, Cabinet proposed that those convicted of raping disabled persons or minors below the age of 12 years be sentenced to a mandatory 60- year jail term.

The Ministers also said other rape cases and sodomy should attract no less than a 40- year jail term.

    This is rape the guy should be placed behind bars, he has a suspect in custody but goes on to rape her knowing very well she will be unable to defend herself against an ‘armed’ officer worse this is an under age girl. Women need to be protected against this form of crime that befall them in the cells

    In my books s*x by blackmail is rape. If for instance the statement was “if you have s*x with me I won’t kill you” or if you don’t have s*x with me I will kill you” there is not much difference. The person is being forced to make a decision to get out of the situation she is in. I would love to prosecute this case. This is a definIte Jail sentence IMHO.

        It would be good arguing with you in Court. If I was the Prosecutor in this case I would bring about several charges so as not to have all the eggs in one basket. The man admitted he took money from the girl under false pretence so the word swindle would come to mind. Corruption would be the next charge because this was dishonest or fraudulent conduct one in power, and it involved bribery. By the time I was finished with him he would be glad to take the rape charge alone. Thanks makhosi. You are a true debater.

          The Policeman has admitted that he broke the Law by his actions. His blameworthiness is high because of this. Why would I as a Magistrate believe him over someone who is a suspect in a theft. There are many people that have been arrested from time to time due to mistaken identity or being in the wrong place at the wrong time. Don’t get me wrong. This is a debate so maybe she has done an admission of guilt but a Policeman will always get a rougher deal if he admits to doing such simply because his job is to serve and protect. This is an abuse to the authority vested in him and it taints the Police forces record when some of them cannot be trusted.

      I will tell you a story…an analogy if you will..
      I’m stopped at a roadblock and am detained for driving without a licence.
      I offer the officer a $20 bribe to let me go
      The officer accepts my bribe and I drive off
      Later in the week I receive a summons to appear in court for driving without a licence.
      I’m outraged and I report the officer for theft…
      Who is guilty of what?
      If the girl had not been taken to court she would never have screamed rape cause the deal would have been mutually satisfactory.
      Here is another scenario
      If Legal Eagle sleeps with a prostitute after promising to pay her $10 and then refuses to pay after the act.Can she then accuse him of rape?

What authority has a Policemen to make his own deals with a prisoner that benefit himself? This man will not be facing a “village court” in which maybe you preside in.Your examples have a place in village Kangaroo courts not a proper court. Your scenarios are rather silly for a grown man who wants to have himself heard. Childish to say the least. Legal Eagle is not a Policeman and the prostitute you speak about won’t be under his Jurisdiction. However If legal Eagle was the presiding Judge in this case or part of the judiciary and your bizarre scenario happenned and then Legal Eagle would deserve the harsher sentence for abuse of his Office and contempt of the Judiciary system.

          That is a funny one. Trouble is many in Zimbabwe are now fine tuned to deals in everything. The Police are dealers. The Passport office people do deals.The Hospitals do deals. Even the so called Prophets are doing deals. This is one corrupt country so don’t blame Ndlukula Ye Sizwe for his opinion. He is too used of deals.
