THE Bulawayo Jewish Congregation has taken Speciss College to court seeking an eviction order over a debt of more than $12 000 in unpaid rentals and operational costs at its building in the city.

The Bulawayo Jewish Congregation, has through its lawyers, Coghlan and Welsh Legal Practitioners, filed summons at the Bulawayo High Court seeking an order compelling Speciss College to pay $12 970,77 being outstanding rentals and operating costs for occupying its building situated along Jason Moyo Street  between 2nd and 3rd Avenue in Bulawayo.

In papers before the court, The Bulawayo Jewish Congregation cited Speciss College as the defendant.

The church entered into a lease agreement with Speciss College in January 2017. In terms of the lease agreement, the college was supposed to pay a monthly rent of $3 460 excluding VAT and operating costs.

The premises were let to Speciss College for use as educational and ancillary facilities.

The Bulawayo Jewish Congregation said Speciss College has breached the lease agreement by failing to pay the outstanding rentals. The church wants to cancel the lease agreement and evict Speciss College from its rented premises.

“In breach of the lease agreement, the defendant has failed to pay the agreed rental due in the amount of $12 970,77. In view of the breaches, plaintiff wishes to exercise its right to cancel the lease agreement,” said Bulawayo Jewish Congregation.

The church seeks an order directing Speciss College to pay the outstanding rentals and hold over damages equivalent to the monthly rental of $3 460 together with VAT and operating costs incurred from November 1 in 2017.

In the event that the Bulawayo Jewish Congregation is granted the order, it wants Speciss College to also pay the outstanding money with a five percent interest calculated from the date of summons to the date of full and final payment and legal costs.
