Man fined US$600 for attempted murder

Joseph Mamutse had pleaded guilty to attempted murder when he appeared before regional magistrate Mr Never Katiyo.
Mr Katiyo fined him US$600 or six months in prison coupled with a wholly suspended three-month jail term.

The firearm was forfeited to the State.
Mamutse’s firearm certificate was cancelled and he was barred from applying for one in the next two years.

Passing sentence, Mr Katiyo said he considered that Mamutse was a family man and a first offender who had pleaded guilty, thereby saving the court’s time.
He said he had shown remorse and had felt provoked at the time of commission of the crime.
“Accused had a duty to protect his child. However, accused finds himself convicted of a serious offence. The sanctity of life should always be preserved, it was fortuitous that complainant was hit on the buttock,” he said.

Agreed facts are that on December 31 last year, Mamutse unexpectedly returned to his Msasa Park home from work and found his daughter (16) with her 21-year-old boyfriend Sheppard Rundofa who tried to hide in a bedroom but Mamutse saw him and shot him on the left buttock.-The Herald
