Mpilo boss slapped with $130,000 lawsuit

BULAWAYO businessman, Ashton Mpofu has filed a $130,000 lawsuit against Mpilo Central Hospital’s director of operations, Duduza Regina Moyo for allegedly failing to pay for construction costs for her house in Romney Park.According to summons filed at the Bulawayo High Court on March 16, Mpofu is the plaintiff while Moyo was cited as the defendant.

Mpofu, who is a self-actor in the matter, said Moyo breached a verbal agreement reached in 2010 to pay for the construction of her house on completion in January this year.

He said she contracted him to build the house on the understanding that he would provide the building materials and labour and she would pay later.

“Sometime in 2010, Moyo and I concluded a verbal agreement whereby the defendant contracted me to construct a house for her in Romney Park. She then provided me with a plan, which was approved by the Bulawayo City Council,” said Mpofu.

He said as part of the agreement, Moyo was supposed to pay the bill once the house was roofed.

“In January 2015 after roofing had been done, I tendered the bill of $130,000 to Moyo. Since January to date defendant has neglected to pay despite numerous promises to do so,” said Mpofu.

The businessman is also claiming interest on the $130, 000 and the cost of suit at attorney-client scale.

Mpofu is also seeking an order to depose of the house to recover the debt in the event that Moyo fails to settle the bill. Moyo has not yet filed opposing papers.

Last month Mpofu filed a $1 million lawsuit against Moyo, accusing her of lying that she received death threats from him following the cancellation of a $3 million tender awarded to his company by Mpilo Central Hospital.

Mpofu owns Ashy’s supermarkets, commuter omnibuses, cross-border buses and a petrol station in Nkulumane.
