OWNERS of a building housing Roy’s Kitchen in Bulawayo have approached the High Court seeking an order to evict the restaurant director Roy Sibanda over refusal to pay rent totalling almost $20,000.
The rentals have been accruing since March last year.
Sibanda is also Affirmative Action Group Matabeleland Chapter president.

According to summons filed at the High Court in June, Reign of Fire Investments (Pvt) (Ltd) is praying the courts will confirm the cancellation of a lease agreement with Towerport Investments (Pvt) (Ltd) trading as Roy’s Kitchen’s for failure to pay monthly rentals of $1,148.79 since March 2013.

The plaintiff also seeks an order that the defendant vacates shops 9 and 10 Mays Building, 12th Avenue in the city within 48 hours of granting and Sibanda pays arrear rentals and other charges at the agreed $1,148.79 per month. The rentals multiplied by 15 months amount to $19,526.43.

According to the plaintiff’s declaration, Towerport Investments (Pvt) (Ltd) “has failed, refused and or neglected to pay the rentals at all or on time as a result the plaintiff has cancelled the lease agreement”.

“Despite lawful demand, the defendant has refused or neglected to vacate the premises with those claiming through it,” read the court papers.

Sibanda was served with the summons on 30 June and entered an appearance to defend on 9 July.
