HIGHLANDERS Football Club board of directors chairman, Mgcini Mike Nkolomi has been dragged to court by Delta Beverages for failing to settle a debt of more than $25,000 for beverages supplied to his bottle store in Gwanda last year.

Delta Beverages, which is the plaintiff in the matter, this week filed summons at the Bulawayo High Court citing Nkolomi, a prominent businessman, as the defendant.

The beverages manufacturing and distribution company is demanding the sum of $25,081,71 which it is owed by Nkolomi through his nightclub, Cry Mantengwane in Gwanda.

Delta Beverages, which is a self actor, in its summons, said Nkolomi had continuously failed, refused or neglected to settle the outstanding amount despite demand.

“Sometime in 2014, Cry Mantengwane was supplied with beverages on the understanding that the defendant would pay for the service as per agreed time. Nkolomi did not honour the agreement and despite lawful demand, the defendant has refused and neglected to pay the account,” said Delta Beverages.

In the court papers, Delta Beverages is demanding that the defendant pay the debt at a prescribed interest rate per annum (a tempore morae) from the date of issue of summons to the date of full and final payment and cost of suit at attorney-client scale.

“Wherefore plaintiff claims for an order for payment of the sum of $25,081,71 being the outstanding balance for the service which was rendered to the defendant by the plaintiff, which according to the contract had agreed to pay,” said Delta Beverages in its summons.

Nkolomi has not yet filed a notice to enter an appearance to defend the summons.
